Preamble
Sales are made by Mediproject SAS, referred to as the “Company”, the “Seller” or the “Website”. Customers are natural or legal persons, referred to as the “Buyer” or the “Customer”. These General Terms and Conditions of Sale (GTC) determine the rights and obligations of the parties when selling Products and/or Services.
Definitions
- Website: The Mediproject.eu website where the Products are presented and sold.
- Order: Sales contract concluded between Mediproject and the Customer.
- User manual and sales brochure: Information about a Product, available on the Website before and after the Order.
- Adjustment guide: Technical information for adjusting CPAP/PPC devices provided at the time of purchase.
- Products: CPAP equipment and accessories sold via Mediproject.eu.
- Transaction: All operations related to the payment of the Products ordered.
Article 1 - Purpose
The GTC define the rights and obligations of the parties in connection with the sale of Products and/or Services. Sales are made from our warehouse, and delivery costs to the Buyer’s address are at the Buyer’s expense. Unless proven otherwise, the data recorded in the Seller’s computer system constitutes proof of the transactions concluded.
Article 2 - Acceptance of terms and conditions
Mediproject.eu sells new medical devices for the treatment of sleep apnoea (CPAP/PPC), accessories and consumables. All devices comply with French regulations and are certified by an independent body before being placed on the market.
Warnings and precautions for use: The choice of product is the responsibility of the Customer. It is advisable to consult your prescribing doctor for any questions regarding the use and specific features of the devices.
CPAP/PPC devices are delivered with the manufacturer’s default settings.
For CPAP/PPC devices, the Customer undertakes to:
- Read the user manual and brochure.
- Adjust the pressure settings according to their doctor’s prescription using the adjustment guide provided at the time of purchase.
- Comply with their medical prescription, bearing in mind that any changes to the settings are their responsibility.
- Consult a healthcare provider regularly for medical follow-up and to adapt the treatment to their needs.
- Comply with the care and maintenance rules.
Users must report any incident involving a device to the French Health Products Safety Agency and inform Mediproject.eu of any difficulties encountered.
Coverage by health insurance:
To date, the sale of CPAP devices is not covered by health insurance.
Any order implies the Buyer’s unconditional acceptance of these GTC.
Article 3 - Characteristics of products and services
The products and services offered by the Seller are specifically designed for the treatment of Obstructive Sleep Apnoea, including goods, parts and accessories. The photos showing the products on the website www.mediproject.eu are for illustrative purposes only and are not contractual.
Article 4 - Prices
The prices of items presented on the website www.mediproject.eu are expressed in euros, including all French taxes.
For professional buyers placing orders by post or email, prices are indicated excluding taxes. VAT and other taxes applicable on the day of the order will be added when invoicing, unless otherwise specified and excluding processing and shipping costs.
In the case of orders to countries other than mainland France, the Buyer shall act as the importer of the products concerned. Customs duties or other local taxes may be payable. These costs are not the responsibility of Mediproject SAS and shall be borne exclusively by the Buyer, who must obtain information on these aspects from the competent authorities.
All orders, regardless of their origin, are payable in euros. The Seller reserves the right to change its prices at any time. However, the product will be invoiced at the price in force at the time of order confirmation, subject to availability.
The products remain the property of the Seller until full payment of the invoice. Upon physical possession of the products, the risks of loss or damage are transferred to the Buyer.
Article 5 - Orders
Orders can be placed by email at info@mediproject.eu or directly on the website: https://www.mediproject.eu.
Contractual information will be provided in French, English or German and will be confirmed at the latest when the order is validated.
Product offers are valid as long as they are visible on the website, subject to availability.
The Customer must check that the products ordered correspond to their needs and to the medical prescription in their possession.
The sale will only be considered final after the Seller has sent confirmation of acceptance of the order to the Buyer by email and after payment has been received. The Customer must check the accuracy of their order and report any errors immediately.
Any order placed on the Website constitutes the formation of a distance contract between the Customer and the Seller. The Customer will be informed by email of the progress of their order at the address provided when placing the order. The photos showing the products on the website www.mediproject.eu are not contractually binding.
The Website’s automatic recording systems are considered proof of the nature, content and date of the Order.
The Seller reserves the right not to record a payment and not to confirm an order for any reason, in particular in the event of a supply problem or difficulty concerning the order received.
Article 6 - Confirmation of your order
Any order placed with the Seller in any form whatsoever implies full and unreserved acceptance of these General Terms and Conditions of Sale. All the data provided and the recorded confirmation will constitute proof of the transaction, and you declare that you are fully aware of this. The order confirmation shall be deemed to constitute signature and acceptance of the transactions carried out. A summary of your order information and these General Terms and Conditions of Sale will be sent to the email address provided when you placed your order.
Article 7 - Order modifications
For orders placed via the website www.mediproject.eu, no modifications will be accepted once payment has been made, unless you contact the Seller by email at info@mediproject.eu. Given that shipping times for online orders are 24 hours for products in stock, the possibilities for modifications will be limited.
For orders placed by email, changes may be accepted until the time of payment.
Article 8 - Payments
By confirming your order on the website www.mediproject.eu, you agree to pay the price indicated. The following payment methods are accepted:
- Payment by credit card: The card must be debited to confirm the order.
- Payment by bank transfer: The order will be confirmed upon receipt of the transfer.
For orders placed by e-mail, the payment terms will be agreed between the Seller and the Buyer, in particular:
- Pricing conditions,
- Terms and conditions of payment by bank transfer,
- Shipping methods and terms and conditions of delivery.
Article 9 - Withdrawal
In accordance with Article L.121-21 of the French Consumer Code, you have a withdrawal period of 15 days from receipt of your products to exercise this right without having to justify your decision or pay a penalty. You can exercise your right of withdrawal online or by email to info@mediproject.eu, attaching a copy of the invoice or order form and indicating the date of receipt of the products concerned.
The Products must be returned in their original packaging, in perfect condition, undamaged, and accompanied by all accessories, user manuals and documentation, as well as a copy of the purchase invoice, to the following address:

You are liable for any damage to the product during return shipping, which may invalidate your right of withdrawal. Return shipping costs are the responsibility of the Purchaser.
Given that the majority of products offered for sale are medical devices, no product whose packaging has been opened or damaged, or which is no longer sterile, can be returned or exchanged.
If you exercise your right of withdrawal, MEDIPROJECT will refund the sums paid within 14 days of notification of your request, using the same payment method used when placing the order, after receipt of the item(s) concerned.
Exceptions to the right of withdrawal
- Provision of services: When services have been fully performed before the end of the withdrawal period, if their performance began with the consumer’s prior agreement and their express waiver of their right of withdrawal.
- Products subject to price fluctuations: When the price of goods or services depends on fluctuations in the financial market beyond the control of the professional and which may occur during the withdrawal period.
- Personalised products: For goods made to the consumer’s specifications or clearly personalised.
- Perishable goods: For goods that are likely to deteriorate or expire rapidly.
- Unsealed goods: When the goods have been unsealed by the consumer after delivery and cannot be returned for reasons of hygiene or health protection.
- Mixed products: For goods that, after delivery, are inseparably mixed with other items.
- Digital content: For the supply of digital content not provided on a tangible medium, where the performance has begun after the consumer’s prior express agreement and express waiver of their right of withdrawal.
Article 10 - Availability
Products are offered as long as they are visible on the website www.mediproject.eu and while stocks last. For products that are not in stock, our offers are valid subject to availability from our suppliers.
If a product is unavailable after you have placed your order, you will be notified by email. Your order will then be automatically cancelled and refunded if payment has already been made.
Furthermore, MEDIPROJECT reserves the right to refuse orders for 100 or more identical items, as the website is not intended for selling in large quantities.
Article 11 - Delivery
Products are delivered to the address provided during the ordering process. For any address changes, please contact the Seller at the following email address: info@mediproject.eu. The change will be taken into account after confirmation from us.
Subject to full payment, the products will be shipped to the address specified in your Order within a maximum of 15 working days. Orders are shipped by GLS or another carrier.
The Seller undertakes to make every effort to deliver the products within the specified time frame. However, shipping times are indicative.
If the products ordered are not delivered within 30 days of the indicative delivery date, for a reason other than force majeure or the Customer’s fault, the sale may be cancelled at the Customer’s written request, in accordance with the conditions of Articles L 138-2 and L 138-3 of the French Consumer Code. The sums paid will then be refunded within 14 days of the termination of the contract, excluding any compensation.
Unless otherwise specified or unavailable, the products ordered will be delivered in a single shipment. The goods travel at the Seller’s risk, who has recourse against the carrier in the event of damage during transport.
Before signing the delivery note, we recommend that you check the number of packages and the condition of the items. Clearly note any anomalies and follow the instructions for issuing your reservations, otherwise you will not be able to invoke these reservations. Please note that the term “subject to reservation” is not valid.
In the event of delivery by a carrier, MEDIPROJECT cannot be held responsible for delays due to the Customer’s unavailability after several attempts to arrange a delivery appointment.
Article 12 - Warranty
All our products are covered by the legal warranty of conformity and the warranty against hidden defects, in accordance with Articles 1641 et seq. of the French Civil Code. The commercial warranty is specific to each product and is provided by the manufacturer. It is granted by the manufacturer, who is legally responsible for it.
In the event of non-conformity of a product, it may be returned, exchanged or refunded. Complaints must be made via your customer account within 30 days of delivery. Products must be returned in the condition in which you received them, with all items included (accessories, packaging, instructions).
The Seller will refund, replace or repair products deemed non-compliant or defective. Shipping costs will be refunded at the invoiced rate and return costs will be refunded upon presentation of supporting documents.
The Seller shall not be held liable:
- in the event of misuse, negligence or lack of maintenance on the part of the Customer,
- in the event of normal wear and tear of the product, accident or force majeure.
The additional commercial warranty does not apply to commitments made by manufacturers, as specified in the instructions for use.
No work on the devices may be carried out except by a technician approved by the brand of the device in question, under penalty of forfeiture of the contractual warranty, where applicable.
No claims will be accepted for defects or malfunctions resulting from failure to comply with the instructions for use and maintenance, or from damage or impact caused by the Customer.
If a device has a defect or malfunction during the applicable legal or commercial warranty period, please contact us by email at info@mediproject.eu, describing the defect or malfunction.
The customer may not claim any compensation for loss of use.
All devices must be returned in their original packaging.
Article 13 - Liability
The products offered comply with current French legislation. MEDIPROJECT cannot be held liable in the event of non-compliance with the legislation of the country of delivery. The Purchaser must check with the local authorities regarding the possibilities of importing and using the products ordered.
Furthermore, MEDIPROJECT cannot be held liable for damage resulting from misuse of the products purchased or for any inconvenience or damage related to the use of the Internet, such as service interruption, external intrusion or computer viruses.
Article 14 - Applicable law in the event of disputes
The original language of this contract is French. These General Terms and Conditions of Sale are subject to French law. In the event of a dispute, only the French courts shall have jurisdiction.
Article 15 - Intellectual property
All elements on the www.mediproject.eu website remain the exclusive property of MEDIPROJECT. No one is authorised to reproduce, exploit, rebroadcast or use, even partially, these elements, whether software, visual or audio, without the express written consent of MEDIPROJECT. Any link, whether simple or hypertext, is strictly prohibited without prior authorisation.
Article 16 - Personal data
MEDIPROJECT reserves the right to collect personal information and data about you. This information is necessary for managing your order and improving the services we offer you.
This data may also be shared with companies that contribute to the management of your orders and services. It is stored for security reasons for a maximum period of 15 years, in accordance with legal and regulatory obligations.
In accordance with the law of 6 January 1978, you have the right to access, rectify and oppose your personal information, which you can exercise directly on our website.
Article 17 - Archiving and evidence
MEDIPROJECT shall archive purchase orders and invoices on a reliable and durable medium, thereby constituting a copy in accordance with the provisions of Article 1348 of the French Civil Code. MEDIPROJECT’s computerised records shall be considered as proof of communications, orders, payments and transactions between the parties.
NB: These GENERAL TERMS AND CONDITIONS OF SALE are a translation of the “CONDITIONS GÉNÉRALES DE VENTE Mediproject”. This translation is non-contractual and therefore not binding. Only the French version is contractually binding.
